A title opinion is the written opinion of an attorney, based on a title search of the public records of the parish where a property is located, describing its current ownership and any liens or clouds upon the title. No one can take it for granted that a seller has an unblemished claim to a particular parcel. A seller always sells subject to properly recorded interests that impinge on the seller’s title. A property that is foreclosed and sold at public auction or sold at a tax sale may be sold free and clear of some interests, but not of others, that impinge on the former owner’s title. A purchaser or potential purchaser is wise to get a written title opinion before investing in real estate.
